We’d just like to apologise for the formal and legal tone of our privacy policy, but it’s required with New Zealand privacy laws, which is good for everyone, really. Just know that basically, we’re a members-only site, we look after our members, and that means we respect your privacy, we don’t share your information with other parties, and we don’t spam people. We try to do good. But here’s the formal stuff that you might like to know…

Our commitment to open and transparent management of your personal information

  1. At Vinomofo we are committed to the open and transparent management of your personal information in line with our obligations under privacy laws and to you as our valued customers.
  2. To offer the goods and services we provide in our business as an online retailer, we will need to collect personal information.
  3. Personal information is defined as information that can identify you in some way.
  4. This policy sets out how we collect and use personal information including: how we collect and protect your information; how we use your information; disclosure of information; our compliance with direct marketing and spam laws; offshore disclosure of information; and how you can correct information or complain about our use of your personal information.
  5. We will only collect information in accordance with the law and through fair means.

Collecting and looking after your information

  1. We only collect personal information which is necessary for our business, and only with your consent.
  2. We collect this information so we can deliver our goods and services to you, carry on our business and provide you with anything else you might require.
  3. On signing up, and placing an order, we will collect from you: your name, email contact, phone number, address, date of birth; and your credit card details if you select that payment method (we do not store credit card details, only payment tokens via our secure payment gateway)
  4. When you visit our website we may automatically collect information about: your computer’s operating system; your computer’s browser type and capability, your computer’s Internet Protocol (IP) Address and geolocation; pages visited on our site, including how you were referred to each page; and web page usage statistics, including the time spent on each web page.
  5. We may record phone calls for customer service training purposes.
  6. We will not identify users or their browsing activities except where we are compelled to by law or in accordance with our website Terms and Conditions.
  7. We store this information on secure cloud servers. These servers are protected by best practice cloud security measures which are in place to protect your personal information from loss, unauthorised access, unauthorised use, modification, disclosure or any other misuse.

Use of your personal information

  1. We use your personal information for the purpose of carrying on our business as an online retailer, including securing payment for and delivering your orders, letting you know about our business and current offers, and any other related activities that you may expect from us.
  2. We may also use that information for a secondary purpose that is related to the above, or otherwise where permitted by law.
  3. We use the sort of information collected from your computer (mentioned in point 4 of ‘Collecting and looking after your information’) for the purposes of managing our website, improving our business and ultimately delivering better results for our customers.

Disclosure of your personal information

  1. If we do disclose your personal information it will only be for the primary purpose for which it was collected or for a related secondary purpose where you would reasonably expect us disclose the information. We may also disclose your personal information in any other way that is required or authorised by you or the law.
  2. Typical situations where your personal information may be disclosed include, but are not limited to disclosure to third parties that provide services such as our payment gateway, marketing, logistic and technology support which are required to fulfil a transaction.

Direct marketing and spam

  1. When you join as a member of Vinomofo you consent to receive direct marketing emails from us (advertising, special offers, updates etc).
  2. We will only ever send you direct marking communications that are consistent with our obligations under the Privacy Act 1993 and the Unsolicited Electronic Messages Act 2007.
  3. We will always make it clear and simple to opt out of these communications and will respond to an opt out request within 5 business days.
  4. There are lots of links that will allow you to opt-out of direct marketing communications on the communications themselves but if they aren’t showing up, for whatever reason, please email team@vinomofo.co.nz to request an opt-out.

Offshore disclosure

  1. Sometimes we may need to disclose your personal information to offshore entities for the purpose of storing and processing our data.
  2. When disclosing your information to a foreign entity it is still our responsibility to ensure your personal information is protected. We ensure, amongst other things, that: the current privacy policy of the foreign entity complies with New Zealand requirements and in line with Vinomofo’s privacy obligations; if necessary, we will seek further agreements or consents from the foreign entity; and we will mitigate any risk of a breach of this privacy policy even when the disclosure is to a foreign entity.

Your rights to correct or complain

  1. We are only allowed to, and only want to, keep your personal information if it is correct.
  2. At any time you can contact us and seek access to or correction of the personal information we hold about you.

  4. If you wish to complain about a breach of your rights under the Privacy Act 1993 please contact us on the email and postal addresses above providing details of your complaint in writing.
  5. We will respond to any complaint within 20 working days. If you aren’t happy with our response you can complain directly to the Privacy Commissioner at https://privacy.org.nz/your-privacy/how-to-complain/.
